Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. WINNER SELECTION AND NOTIFICATION: Sponsor will randomly select nine (9) winners from among eligible entries on or about June 2, 2022 but in no event later than ten (10) business days after the close of the Sweepstakes Period. Limit one prize per winner. Winners will be notified via email at the email address provided at time of entry and must confirm and verify their identity to Sponsor’s satisfaction within the time period requested in such notification. Each winner will be required to execute an Affidavit of Eligibility/Release of Liability/Publicity Release and, where a prize is to be shipped to a winner, provide a valid U.S. mailing address. Prize 1 will be awarded as a digital gift card that can be redeemed by the winner in accordance with annual pass rules. Sponsor will provide winner’s name and email address to the United States Geological Survey (“USGS”) website in order to enable the USGS to deliver the gift card electronically. Winner is solely responsible for accepting and activating the digital gift card and complying with any and all terms and conditions, terms of use and other applicable requirements of the USGS or other cognizant U.S. federal agency; WCS shall be deemed to have delivered Prize 1 regardless of whether winner accepts or rejects it or any requirements applicable to its acceptance, activation or use. LIMITATION OF LIABILITY: Neither Sponsor nor any of the Platform Partners shall be liable to any winner or any other persons for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, epidemic or pandemic, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot or any other cause beyond Sponsor’s reasonable control.

Neither Sponsor nor any of the Platform Partners is responsible or liable to any entrant or any other persons for any incorrect or inaccurate entry or address information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone, broadband, wireless or other network, computer online system, postal service, delivery service, computer equipment, server, provider, mobile device or software, including without limitation any injury or damage to entrant’s or any other person’s computer or mobile device relating to or resulting from participation in this Sweepstakes; theft, tampering, destruction, or alteration of, or unauthorized access to, entries; data that is processed late or incorrectly or that is incomplete or lost due to computer or electronic malfunction or traffic congestion on transmission lines or the Internet or for any other reason whatsoever; typographical, printing or other errors; or any combination thereof.

RIGHTS GRANTED BY ENTRANTS: By entering this Sweepstakes, each entrant understands and agrees that Sponsor, the Platform Partners, anyone acting on behalf of Sponsor or the Platform Partners, and licensees, successors, and assigns of Sponsor or any Platform Partner shall have the right, where permitted by law, in all media worldwide in perpetuity, without remuneration, to use the entrant’s image, likeness, voice and statements provided by the entrant in connection with this Sweepstakes for the Sponsor’s institutional, educational and promotional purposes and for publicizing any Platform Partner’s support of or role in the Sweepstakes. Each entrant must also secure the permission of any recognizable person (or in the case of a minor, the minor’s parent or guardian) whose image or likeness appears in any photograph or video for all purposes described herein, and present satisfactory evidence of such permission to the Sponsor if requested. The Sponsor reserves the right to disqualify any entry if the Sponsor finds, in its sole discretion, that an entrant has not secured the necessary permission.

GENERAL: Entrants release and waive any claims they may have against Sponsor, the Platform Partners, and each of their respective affiliates, and each of their respective trustees, officers, employees and agents for any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorneys’ fees) resulting from acceptance, use, or misuse of the prize; participation in this Sweepstakes; or any technical malfunctions of the telephone network and/or transmission line, computer on-line system, postal service, delivery service, computer, mobile device or transmission device or its dating mechanism, equipment, hardware, software, or any combination thereof, or any entries that are late (including delayed data transmissions), tampered with, garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, mechanically duplicated, illegible or otherwise not in compliance with these Official Rules. This Sweepstakes is in no way sponsored by, endorsed by, administered by or associated with the USGS or any other department, bureau, agency or service of the U.S. government.

By entering this Sweepstakes, entrants affirm that they have read and accepted these Official Rules. This Sweepstakes shall be governed by and construed in accordance with the laws of the State of New York. By entering this Sweepstakes, entrants hereby submit to the jurisdiction and venue of the federal and state courts of New York and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum.

If for any reason it is not possible to operate this Sweepstakes as planned, or if this Sweepstakes or any account address associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of this Sweepstakes and processing of entries in accordance with these Official Rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants (including without limitation those deemed by Sponsor in its sole discretion to be outside the spirit of the Sweepstakes), fraud, technical failures, or any other causes, that in the Sponsor’s sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify or suspend this Sweepstakes or any portion thereof.

Sponsor reserves the right to place into a time-out any entrant who attempts to use the Site in a manner that exceeds the reasonable usage or rate limits determined by the Sponsor. While in a time-out, entrants will not be able to earn any points in the Sweepstakes. Repeat offenders may be disqualified at Sponsor’s sole discretion.

If a dispute arises about who submitted an entry, the entry will be deemed submitted by the authorized account holder of the email account associated with the entry. The authorized account holder is deemed the natural person who is assigned to an email address by an Internet access provider, service provider, or other online organization with such responsibility. A potential winner may be requested to provide the Sponsor with proof of identity and proof that the potential winner is the authorized account holder of the email address associated with the winning entry and that all eligibility requirements are met.

Notwithstanding the foregoing, Sponsor reserves the right, in its sole discretion, to cancel or modify this Sweepstakes for any reason or no reason.
