Use by Children

The Site is intended to be accessible and enjoyed by general audiences but WCS does not offer or sell any product or service through this Site to children under the age of 13. WCS does not knowingly collect personal information from children under the age of 13 on any of its websites without first providing the parent or legal guardian with notice and obtaining prior verifiable consent. Where a WCS website is specifically directed toward children under the age of 13, the terms of the Children’s Privacy Policy found on that website will apply.

Accounts

Some WCS sites and services permit or require you to create an account to participate or to secure additional benefits. You will have the opportunity to review and confirm your order, including delivery address (if applicable), payment method and product details. At such time, the contract for sale will be made and become binding. WCS is not responsible for your data usage and will not be responsible for excessive data charges that you may incur. You are responsible for any Internet connection, data or other fees assessed by your mobile network carrier to access the Site via your wireless device, including any data plan charges, toll, out-of-area, roaming or other wireless device connection charges.

Severability and Nonwaiver

If any provision of these Terms of Use shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions. The failure of WCS to insist upon or enforce strict performance of any of the provisions of these Terms of Use or to exercise any rights or remedies under these Terms of Use will not be construed as a waiver or relinquishment to any extent of WCS’s right to assert or rely upon any such provisions, rights or remedies in that or any other instance; rather, the same will be and remain in full force and effect.

Applicable Law and Jurisdiction

These Terms of Use and any amendments or revisions shall be governed by applicable United States federal law and the laws of the State of New York, without regard to its conflict of laws principles. Any case, controversy, suit, action, or proceeding arising out of, in connection with, or related to these Terms of Use or the use of the Site shall be brought in the federal judicial district in the Southern District of New York, and you irrevocably consent to personal jurisdiction in the state or federal courts located in the State of New York.

Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE SITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

Use of the Site Outside the United States

The Site is controlled and offered by WCS from the United States. WCS makes no representations that the Site is appropriate or available for use in other locations. If you access the Site from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

If you are located outside of the United States, the information you provide to us will be transferred to the United States and that by providing your Information, you consent to this transfer and storage of the data in the United States.

Termination

Notwithstanding any of these Terms of Use, WCS reserves the right, without notice and in its sole discretion, to terminate your use of the Site and to block or prevent future access to and use of the Site.

Data Retention

WCS may maintain backups of data including registration data to recover data and restore accounts in case of errors or system failure. Therefore, data that you delete or that WCS deletes may remain backed. WCS does not guarantee that backups will function error free. WCS may not be able to restore data from a backup on request. For these reasons, you are responsible for maintaining your own backups.

Sweepstakes and Contests

WCS may operate sweepstakes, contests, and similar promotions (collectively “Promotions”) through this Site. You should carefully review the rules (“Official Rules”) of each Promotion in which you participate, as the Official Rules may contain additional terms and conditions. In the event the Official Rules conflict with these Terms of Use, the Official Rules will control.

Wild For All Challenge Registration Sweepstakes 

OFFICIAL RULES

NO PURCHASE OR OTHER CONSIDERATION IS NECESSARY TO ENTER OR WIN. A PURCHASE OR THE PROVISION OF OTHER CONSIDERATION WILL NOT IMPROVE YOUR CHANCES OF WINNING. ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED. VOID WHERE PROHIBITED.

The Wild for All Challenge Registration Sweepstakes (the “Sweepstakes”) starts at 12:00am Eastern Time (“ET”) on April 13, 2022 and ends at 11:59pm ET on June 1, 2022 (the “Sweepstakes Period”). The sponsor of this Sweepstakes is the Wildlife Conservation Society (“Sponsor”), with a principal place of business at 2300 Southern Boulevard, Bronx, NY 10460, USA. This Sweepstakes shall be subject to these Official Rules, and by entering all entrants agree to be bound by the terms and conditions herein. Certain restrictions may apply.

ELIGIBILITY: This Sweepstakes is open only to legal residents of the fifty United States (not including territories and possessions) and the District of Columbia who are eighteen (18) years of age or older as of the date the Sweepstakes begins. The officers, trustees, directors, partners, employees and agents of Sponsor and those of Freeborne Impact, Higher Ground Productions LLC, Leaders’ Quest UK Foundation and Netflix Entertainment, LLC (collectively, the “Platform Partners,” and each, a “Platform Partner”), and each of Sponsor’s and any Platform Partner’s respective affiliates, and the immediate family members and those living in the same household of the foregoing, are not eligible to enter. No purchase or other consideration is necessary to enter this Sweepstakes. All federal, state and local rules and regulations apply. Void where prohibited by law.

HOW TO ENTER: Limit one (1) entry per entrant for the duration of this Sweepstakes. Entrants are automatically entered into the Sweepstakes if, at any time during the Sweepstakes Period, they register on the Wild for All website (wildforall.org). Prior to 11:59pm ET on June 1, 2022, any individual can opt out of automatic entry into this Sweepstakes by (1) refraining from registering on the Site; or (2) sending an email to [email protected] containing the individual’s name, address and email address, identifying this Wild for All Challenge Registration Sweepstakes, and using the subject line OPT OUT. 

Email alternative method of entry (FREE): Entrants may enter this Sweepstakes free of charge by emailing the entrant’s first and last name, full address, date of birth, day and evening phone numbers, and email address to [email protected]. All email entries must use the subject line “Wild for All Challenge Registration Sweepstakes” and be received by 11:59pm ET on June 1, 2022. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or mail-in entries, which will be disqualified. Anything to the contrary herein notwithstanding, email entrants are not required to register on the Site or earn and document points in order to be eligible to win a prize.

WINNER SELECTION AND NOTIFICATION: Sponsor will randomly select nine (9) winners from among eligible entries on or about June 2, 2022 but in no event later than ten (10) business days after the close of the Sweepstakes Period. Limit one prize per winner. Winners will be notified via email at the email address provided at time of entry and must confirm and verify their identity to Sponsor’s satisfaction within the time period requested in such notification. Each winner will be required to execute an Affidavit of Eligibility/Release of Liability/Publicity Release and, where a prize is to be shipped to a winner, provide a valid U.S. mailing address. Sponsor is not responsible for changes to entrant’s email address after the date on which they enter the Sweepstakes. If the selected winner cannot be contacted, fails to reply to the winner notification as requested, is ineligible, fails to execute and return the Affidavit of Eligibility/Release of Liability/Publicity Release, fails to claim the prize in a timely manner, or otherwise fails to comply with these Official Rules, the selected winner will be disqualified and an alternate winner may be selected, time permitting. Sponsor reserves the right to verify the eligibility of the winners. 

Acceptance of a prize constitutes permission for Sponsor to use the winner’s name and likeness for promotional and publicity purposes in any media now known or hereinafter developed, in perpetuity, without additional consideration or compensation, permission, notification or limitation unless prohibited by law. 

All decisions of Sponsor regarding the selection, notification and substitution of the winners in accordance with these Official Rules shall be binding and final. 

\nPRIZES

Prize 1 will be awarded as a digital gift card that can be redeemed by the winner in accordance with annual pass rules. Sponsor will provide winner’s name and email address to the United States Geological Survey (“USGS”) website in order to enable the USGS to deliver the gift card electronically. Winner is solely responsible for accepting and activating the digital gift card and complying with any and all terms and conditions, terms of use and other applicable requirements of the USGS or other cognizant U.S. federal agency; WCS shall be deemed to have delivered Prize 1 regardless of whether winner accepts or rejects it or any requirements applicable to its acceptance, activation or use. Prize 2, Prize 3, Prize 4 and Prize 5 will each be shipped at Sponsor’s expense, via such delivery method as Sponsor may choose, to the winner’s valid mailing address within the U.S. Sponsor will provide winner’s name and address to the delivery service provider in order to enable the delivery service provider to deliver the prize to winner. Sponsor is not responsible for incorrect or invalid mailing addresses or delivery delays. At Sponsor’s sole discretion, a prize that differs from those listed above, including any part thereof, may be substituted with one of comparable or greater value, or Sponsor may add additional prizes.

Winners may not make prize substitutions. Prizes are not transferable or redeemable for cash.

All applicable federal, state and local taxes, duties, tariffs, title fees, licensing fees, or other fees associated with the acceptance and/or use of the prize(s), if any, are the sole responsibility of the prize winner.

LIMITATION OF LIABILITY: Neither Sponsor nor any of the Platform Partners shall be liable to any winner or any other persons for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, epidemic or pandemic, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot or any other cause beyond Sponsor’s reasonable control.

Neither Sponsor nor any of the Platform Partners is responsible or liable to any entrant or any other persons for any incorrect or inaccurate entry or address information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone, broadband, wireless or other network, computer online system, postal service, delivery service, computer equipment, server, provider, mobile device or software, including without limitation any injury or damage to entrant’s or any other person’s computer or mobile device relating to or resulting from participation in this Sweepstakes; theft, tampering, destruction, or alteration of, or unauthorized access to, entries; data that is processed late or incorrectly or that is incomplete or lost due to computer or electronic malfunction or traffic congestion on transmission lines or the Internet or for any other reason whatsoever; typographical, printing or other errors; or any combination thereof.

RIGHTS GRANTED BY ENTRANTS: By entering this Sweepstakes, each entrant understands and agrees that Sponsor, the Platform Partners, anyone acting on behalf of Sponsor or the Platform Partners, and licensees, successors, and assigns of Sponsor or any Platform Partner shall have the right, where permitted by law, in all media worldwide in perpetuity, without remuneration, to use the entrant’s image, likeness, voice and statements provided by the entrant in connection with this Sweepstakes for the Sponsor’s institutional, educational and promotional purposes and for publicizing any Platform Partner’s support of or role in the Sweepstakes. Each entrant must also secure the permission of any recognizable person (or in the case of a minor, the minor’s parent or guardian) whose image or likeness appears in any photograph or video for all purposes described herein, and present satisfactory evidence of such permission to the Sponsor if requested. The Sponsor reserves the right to disqualify any entry if the Sponsor finds, in its sole discretion, that an entrant has not secured the necessary permission. 

GENERAL: Entrants release and waive any claims they may have against Sponsor, the Platform Partners, and each of their respective affiliates, and each of their respective trustees, officers, employees and agents for any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorneys’ fees) resulting from acceptance, use, or misuse of the prize; participation in this Sweepstakes; or any technical malfunctions of the telephone network and/or transmission line, computer on-line system, postal service, delivery service, computer, mobile device or transmission device or its dating mechanism, equipment, hardware, software, or any combination thereof, or any entries that are late (including delayed data transmissions), tampered with, garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, mechanically duplicated, illegible or otherwise not in compliance with these Official Rules. By entering this Sweepstakes, entrants affirm that they have read and accepted these Official Rules. This Sweepstakes shall be governed by and construed in accordance with the laws of the State of New York. By entering this Sweepstakes, entrants hereby submit to the jurisdiction and venue of the federal and state courts of New York and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum.

If for any reason it is not possible to operate this Sweepstakes as planned, or if this Sweepstakes or any account address associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of this Sweepstakes and processing of entries in accordance with these Official Rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants (including without limitation those deemed by Sponsor in its sole discretion to be outside the spirit of the Sweepstakes), fraud, technical failures, or any other causes, that in the Sponsor’s sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify or suspend this Sweepstakes or any portion thereof. 

Sponsor reserves the right to place into a time-out any entrant who attempts to use the Site in a manner that exceeds the reasonable usage or rate limits determined by the Sponsor. While in a time-out, entrants will not be able to earn any points in the Sweepstakes. Repeat offenders may be disqualified at Sponsor’s sole discretion. 

If a dispute arises about who submitted an entry, the entry will be deemed submitted by the authorized account holder of the email account associated with the entry. The authorized account holder is deemed the natural person who is assigned to an email address by an Internet access provider, service provider, or other online organization with such responsibility. A potential winner may be requested to provide the Sponsor with proof of identity and proof that the potential winner is the authorized account holder of the email address associated with the winning entry and that all eligibility requirements are met.

Notwithstanding the foregoing, Sponsor reserves the right, in its sole discretion, to cancel or modify this Sweepstakes for any reason or no reason.
